Declaration of estate, prepared by the heirs

The heirs and life insurance beneficiaries must prepare a declaration listing the assets and liabilities of the deceased. A notary can also take care of this.

 

The Belgian registration authorities must receive this declaration of estate within 4 months of the death. This period is set at 5 months if death occurs in another European country and 6 months if it occurs in a non-European country.

 

The law prescribes the form and content of the declaration of estate. A standard document can be obtained from the registration authorities.

 

Generally, the heirs should submit a joint declaration but each can prepare his or her own.

 

The declaration of estate must include:

  • details of the deceased, any spouse and the heirs;
  • any gifts; and
  • the estate's assets and liabilities.
